2. WEBSHOP TERMS AND CONDITIONS
 General terms and conditions for trading via the OUTDOORSTATION® online shop for Switzerland and the Principality of Liechtenstein. 

2.1 Scope
These General Terms and Conditions (hereinafter 'Terms and Conditions') apply to all contracts that OUTDOORSTATION® / Solo Products GmbH, HR number 1288517 , with persons or companies domiciled or based in Switzerland or the Principality of Liechtenstein (hereinafter 'Customer') about products (hereinafter 'Products') offered in the OUTDOORSTATION® webshop (hereinafter 'Webshop'). By placing an order in the OUTDOORSTATION® webshop, the customer accepts these terms and conditions. Deliveries, services, offers, etc. from OUTDOORSTATION® via the web shop are carried out exclusively in accordance with these General Terms and Conditions. The General Terms and Conditions apply in the current version at the time the contract is concluded. OUTDOORSTATION® reserves the right to change these terms and conditions at any time. 

2.2 User account/customer details
The customer places orders via a user account or as a guest in the OUTDOORSTATION® web shop. All customer information in the user account and all information as a guest must be complete and true. Each customer is only allowed to open one user account. 

2.3 Conclusion of contract and delivery
The contract between OUTDOORSTATION® and the customer is only concluded through an express order confirmation or through the shipping confirmation from OUTDOORSTATION® and is dependent on the availability of the ordered products. The buyer remains bound to the order until the express order confirmation or shipping confirmation is received from OUTDOORSTATION®. OUTDOORSTATION®'s offer is primarily aimed at end consumers, which is why OUTDOORSTATION® reserves the right not to fulfill or reject orders, especially if, from OUTDOORSTATION®'s point of view, quantities of products that are not usual for end users are ordered. The prices in Swiss francs valid on the order date and stated in the web shop, including VAT, apply to the products ordered by the buyer. Exchanges and returns of goods are only possible in exceptional cases and with the consent of OUTDOORSTATION®.

The shipping costs are shown separately during the ordering process and in the order confirmation. OUTDOORSTATION® only delivers to delivery addresses within Switzerland or the Principality of Liechtenstein. Shipping route and type of packaging are determined by OUTDOORSTATION®. Delivery dates and/or deadlines stated or communicated by OUTDOORSTATION® are non-binding. If the delay is more than twenty days or if delivery is impossible for more than twenty days, the customer and OUTDOORSTATION® are entitled to withdraw from the contract without compensation.

The following prices are charged:

Prices for the following weights, the entire delivery:

  • Less than 6000g: CHF 9.00
  • Between 6001g - 9000g: CHF 13.00
  • Between 9001g - 15000g: CHF 17.00
  • Between 15001g - 30000g: CHF 24.00

Prices for the following products (flat rate for the whole of Switzerland) :

  • Table tennis tables in a box CHF 130.00
  • Trampolines in a box CHF 130.00
  • Roof tents in a box up to 100kg CHF 185.00
  • Hardboards 160.00
  • Car Awnings 140.00

All other products and deliveries that cannot be offset against the above prices will be charged at cost.

2.4 Rental of roof tents

Pickup and return:
The roof tent is available from the landlord, Solo Products GmbH, Fischingerstr., at the start of the rental period. 66, 8370 Sirnach, to be picked up and returned there at the end of the rental period. Assembly and dismantling are carried out together with the landlord. The roof tent cannot be dismantled independently during the rental period. Subletting or lending to third parties is prohibited.

Rental price:
The rental prices valid at the time of conclusion of the contract apply in accordance with the current price list on the Outdoorstation website outdoorstation.ch

Payment method:
 A deposit of 50% of the rental price fixes the rent. The full rental amount is due at least 3 weeks before the start of the rental period. If the payment deadlines are not met, the landlord reserves the right to cancel the rental.

Deposit:

  1. When the tent is handed over, a deposit of CHF 500 is due in cash or in advance by bank transfer.
  2. The condition of the roof tent is recorded in the acceptance report. If returned properly, the tenant will receive the deposit back.
  3. Loss or damage to roof tents, equipment or camping accessories during the rental period must be reported and will be borne by the renter.

Reservation, cancellation, compensation:

If you cancel before the pickup date, the following costs apply:

  1. up to 42 days before the start of the rental period: 10% of the rental price, max. 100 CHF
  2. between 41 and 14 days before the start of the rental period: 50% of the rental price
  3. less than 14 days before the start of the rental period: 75% of the rental price
  4. If the item is not picked up at the agreed time, 100% of the rental price will be due.

o A replacement tenant can be named but must be accepted by the landlord.

o If returned late, a claim for damages arises.

o An extension of the rent must be discussed with the landlord in advance.

Duty of care:
The tenant is responsible for securing and maintaining the roof tent. Damage, theft or improper use are the responsibility of the tenant.

Behavior in the event of an accident:
In the event of accidents, a European accident report must be drawn up. Everyone involved must leave their details. In the event of failure to do so, the tenant is liable for any damage caused.

Disclaimer:
The tenant is liable for damage during the rental period. Hidden defects can be claimed within 3 days of return. The landlord is not liable for any damage caused by the roof tent.

Leadership authorization:
The driver must be at least 25 years old and reside in Switzerland or Liechtenstein. Participation in certain events and improper use are prohibited.

2.5 Shipping Information

The contract between OUTDOORSTATION® and the customer only comes into effect through an express order confirmation or through the shipping confirmation from OUTDOORSTATION®

2.6 Payment Terms
Payment for all orders must be made in Swiss francs, either by invoice or by credit card. Invoices from OUTDOORSTATION® must be paid within 30 days (without deductions). From the third reminder onwards, OUTDOORSTATION® will charge a processing fee of CHF 40.00. For orders against invoice, OUTDOORSTATION® is entitled to demand advance payment without giving reasons (e.g. due to insufficient creditworthiness). When paying against an invoice, ownership of the delivered goods only passes to the customer after the purchase price has been paid in full.

2.7 Testing, warranty and liability
The customer must immediately check the received shipments or products for accuracy, completeness and freedom from defects. Any deviations from the order and any defects must be reported to OUTDOORSTATION® in writing within 5 calendar days of delivery of the delivery. Returns of defective products must be returned to OUTDOORSTATION®. The shipment must be sent to the following address: Solo Products GmbH, Fischingerstrasse 66, 8370 Sirnach, Switzerland. Packaging and shipping costs are borne by the customer. The warranty obligation can be fulfilled by OUTDOORSTATION® at its own discretion through repair, replacement (with an identical or similar product), reduction of the purchase price or by refund of the purchase price. Other benefits, in particular compensation, are excluded if there is a defect. By purchasing the product, the customer undertakes to use the products solely for their intended purpose. Any further liability of OUTDOORSTATION® in connection with products or services of OUTDOORSTATION® and its auxiliary persons is excluded, to the extent permitted by law.

2.8 Data security and data protection
The data is transferred via the Internet. The Internet is an open network accessible to everyone and is therefore generally not considered a secure environment. All payment transactions are processed according to the usual security standard at the time of the transaction (https://). OUTDOORSTATION® declines any liability for the security of data during its transmission via the Internet. Personal data is processed in accordance with and in compliance with the applicable data protection regulations for the purpose of executing the contract and maintaining relationships with the customer (including marketing measures). The customer's personal data will be passed on to third parties outside the OUTDOORSTATION® Group exclusively to the service partners involved in the contract processing, such as: B. the logistics company commissioned with the delivery. In such cases, the scope of the data transmitted is limited to the minimum necessary for the execution of the contract. Customer data will not be passed on to third parties. The customer agrees to the collection, processing and use of his personal data in accordance with the aforementioned information. Furthermore, the terms and conditions for using the web shop website, which can be found under the data protection section, also apply to buyers. 

2.9 Applicable law and place of jurisdiction
 The contractual relationship, including these General Terms and Conditions, is subject exclusively to Swiss law, excluding the conflict of law provisions of Swiss international private law, in particular excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention). The place of jurisdiction is Sirnach, Kt. Thurgau, Switzerland, whereby OUTDOORSTATION® is also entitled to sue the customer at their general place of jurisdiction.
